Qrush Contacted by Ty Tribble of Passport?
I am sending you this email as a courtesy. Please remove any reference to Passport, Ty Tribble, Dave Stone, Brian Johnson, Bo Short, and their families from your website within 48 hours. If you do not comply I will go forward with a lawsuit. I have already spoken to my attorney and we believe there is cause to proceed with a lawsuit for all or some of the following:
Corporate defamation and/or product disparagement.
Harassment.
Tortious interference with business relations. Again, you have 48 hours to comply.

First of all, Qrush assumes, based on Ty’s email, that he has permission from Passport, Bo Short, Brian Johnson and Dave Stone to represent them legally. Ty – if you don’t have permission from Passport and these guys to act on their behalf, you should call them up and apologize to them and then email me again and let me know that you are only acting on your own behalf.
Next, Qrush has no current plans to “remove any reference” regarding Passport, Ty Tribble, Dave Stone, etc., unless you can get the Supreme Court of the United States or the US Congress to eliminate the 1st Amendment. Qrush has the right of freedom of speech and the right to express opinions. And here is what is really amazing to Qrush. Bo Short, Ty Tribble, Brian Johnson, and Dave Stone have all created blogs and websites that disparage Quixtar, LOS leaders and their businesses, etc., and every time you get criticized for this behavior you stand behind the 1st Amendment and say it is your right to express your opinion. In fact, your disparaging remarks may go over the line and include corporate defamation, product disparagement, harassment, and tortuous interference. Why is it that you believe freedom of speech is only extended to you and your friends?
And even though Qrush can have any opinion I want, Qrush wishes to be as accurate as possible with the facts. Once, for example, Qrush formed an opinion regarding Scott Larsen’s personal life and my opinion was based on information I received that was found later to be inaccurate. When Scott emailed me and pointed out the inaccuracies, Qrush was happy to edit earlier posts in order to make them more accurate. Scott noticed the edits and emailed Qrush thanking me for my cooperation.
The same opportunity has always been available to you, Bo Short, Dave Stone, and Brian Johnson. If you believe I have stated facts that are incorrect and you are willing and able to prove these inaccuracies with real evidence to the contrary, I will certainly edit the inaccurate posts.
To be clear here, Qrush wishes to explain the difference between facts and opinions. If Qrush states that there are exactly 4 active Passport Associates and you can prove that this is incorrect, I’ll start using your number. This is an example of a fact. If Qrush states that the Passport business stinks, that is an opinion, and I’m not interested in changing my opinion.
With that said, and in a good faith effort, Qrush wishes to again extend an olive branch to you and the rest of the Passport blogging minions. I’ll refrain from posting about Passport, Bo Short, you, Dave Stone, and Brian Johnson, on the Qrush blog and I expect all of you to refrain from posting about Quixtar and their LOS leaders and their businesses. Additionally, if any of you guys wish to take down your site, I’ll reciprocate by removing all references to you from the Qrush site. Now how is that for fair play?
Qrush finds it interesting that the first and only email received from you threatens a lawsuit when all you needed to do is contact me to deal with this matter on friendlier terms. Don’t forget, Qrush was drawn into the blogging community because of the anti-Quixtar blogging behavior of you guys. Qrush simply mirrored your behavior. If you guys become model MLM citizens, concentrate on building your Passport businesses in a more positive way, Qrush doesn’t need to exist. Qrush over and out.
The above statements are based on my opinions and experiences as I continue to defend Quixtar against the anti-Quixtar forces while working to find ways to clean up the mud slinging within the MLM industry.
